Open Space Agricultural Use
Preferential treatment: Agricultural land is appraised at its value based on the land's capacity to produce agricultural products, which is determined by capitalizing the average net income the land would have yielded from production of agricultural products during the 5 years preceding the current year. Eligibility does not end because the land ceases to be devoted principally to agricultural use if a drought is declared by the governor and the owner intends to resume when the drought ceases; if service personnel are deplored; land infested with pests or disease. .. Penalty: If the land is changed from agricultural use, a rollback tax of the difference between the taxes imposed in the 3 years preceding the change in use and the tax that would have been imposed on the property's market value in each of those years without the reduced agricultural use appraisal rate is imposed..
