Farmland Assessment Act
Preferential treatment: The New Jersey Farmland Evaluation Advisory Committee publishes a range of fair values for use by assessors based on the productive capability of the land.. Penalty: The Farmland Assessment Act provides for a rollback of taxes if the use of the land changes for the year in which the change takes place as well as the 2 years prior to the conversion.. Eligible land uses: Agricultural/Farmland, Forest Land/Timber Production, Other Land Uses. Eligibility: Plot/Land Size, Income Production, Management Plan, Prior Year's Land Use, Other Eligibility Requirements. Plot criteria: Property must be at least 5 acres actively devoted to agricultural or horticultural use or under a woodlot management plan to be eligible.. Income criteria: The sale of products from the land must average at least $500 gross income for the first 5 acres and $5 per acre for every acre thereafter, except woodland or wetland where the minimum is $0.50 per acre for acreage over the first 5 acres. However, the first 5 acres of woodland or wetland property must still generate at least $500 gross income from sales. Land subject to a forest stewardship plan approved by the Department of Environmental Protection is not subject to income requirements.
