Current Use Taxation Program
Preferential treatment: Eligible land, excluding any building, appurtenance or other improvements on the land, is assessed based on its current use value. Current use value means the assessed valuation per acre based upon the income-producing capability of the land in its current use, solely for growing agricultural crops, and not its real estate market value. This valuation is determined by the assessor according to the range of current use values established by the board as well as the class, type, grade, and location of the land. Only one category of unproductive land is developed which sets its current use value at no more than the lowest current use value established by the board for any other category. Land classified as unproductive must be reclassified as farmland (and/or forestland) if the land becomes accessible or practical to harvest.. Penalty: Land that no longer qualifies for the current use program is subject to a land use change tax, which is 10% of the full and true value of the land that is no longer eligible.. Eligible land uses: Agricultural/Farmland, Conservation/Open Space, Forest Land/Timber Production, Other Land Uses. Eligibility: Plot/Land Size, Income Production. Plot criteria: Tracts totaling 10 or more acres are eligible. Property actively devoted to the growth of agricultural or horticultural crops of less than 10 acres may be eligible if it meets income requirements. Unimproved wetlands of any size are eligible.. Income criteria: A tract of undeveloped land of any size actively devoted to the growth of agricultural or horticultural crops with an annual gross income of at least $2,500 for 4 out of the 5 previous years from the sale of crops normally produced is eligible. Property of more than 10 acres does not need to meet income requirements to be eligible. Unimproved wetlands are not subject to income requirements.
Local Option Taxation of Farm Structures and Land Under Farm Structures
Preferential treatment: In municipalities, towns, or cities that have adopted this provision, qualifying farm structures are appraised at no more than their replacement costs less depreciation. The land under the qualifying farm structures are appraised at no more than 10% of market value. Adoption of the provision requires a majority vote of the locality's legislative body..
