Classified Use Value of Land Classified Agricultural
Preferential treatment: The value is based on its use as agricultural land. The property appraiser shall consider the following use factors only: the quantity and size of the property, the condition of the property, the present market value of the property as agricultural land, the income produced by the property, the productivity of the land in its present use, the economic merchantability of the agricultural product, and such other agricultural factors as may become applicable, which are reflective of the standard present practices of agricultural use and production.. Eligible land uses: Agricultural/Farmland, Forest Land/Timber Production, Other Land Uses. Eligibility: Income Production. Plot criteria: None. Income criteria: While there is no income or production minimum, there must be a good faith commercial agricultural use of the land. Agricultural activity must be viewed as a reasonable expectation of reasonable profit or at least upon a reasonable expectation of meeting investment cost and realizing a reasonable profit. Land classified as agricultural land, which is not being used for agricultural production due to a hurricane on or after 1 July 2017, must continue to be classified as agricultural land for assessment purposes through 31 December 2022, unless the land is converted to nonagricultural use.
Environmentally Endangered Land and Conservation Easement
Preferential treatment: The property appraiser, in valuing land for tax purposes, shall only consider factors relevant to its value for the present use, as restricted by any conveyance or covenant. If the covenant is less than 10 years, the land shall be assessed recognizing the nature and length of the restriction.. Penalty: Upon obtaining approval for a change in use, payment of the deferred tax liability must be paid to the county tax collector within 90 days. Deferred tax liability means the difference between the total amount of taxes that would have been due in each of the previous years in which the conveyance or covenant was in effect if the property had been assessed based on just value and the total amount of taxes paid in those years when the property was assessed under the provisions of this section. If the owner fails to notify the appraiser of a change in use, a penalty of 50% of the avoided taxes plus 15% interest per annum will be assessed.. Exemption for Conservation Easement in Perpetuity
Preferential treatment: Properties that are used exclusively for conservation purposes and have been encumbered by perpetual conservation are fully exempt from property tax. Land dedicated in perpetuity for conservation purposes and used for allowed commercial purposes, provided that the activities are consistent with a management plan, is 50% exempt. Buildings, structures, and other improvements situated on land receiving the exemption and the land area immediately surrounding the buildings, structures, and improvements must be assessed separately; only those auxiliary to the conservation purposes are exempt to the same extent as the underlying land..
